IP Litigation & Enforcement
Bolet & Terrero is widely regarded as a leader for IP litigation and enforcement in Bolivia. We have significant experience in litigating at administrative and at jurisdictional levels. We have litigated before the PTO, before civil and commercial courts and before the Constitutional Tribunal and the Supreme Court.
In most circumstances litigation is a long and expensive process for clients. In Bolivia, the absence of specialized Intellectual Property courts in the jurisdictional venue increases the uncertainty clients face too, and so litigation is only engaged in specific cases and usually as a last resort. The skill to negotiate is highly important and we look at the overall legal strategies factoring into a potential Intellectual Property litigation. Often times, clients must look not just to the dedicated Intellectual Property laws, but also at other trade regulations and commercial laws. Drawing from our extensive corporate expertise, we can navigate an often-difficult legal system, frequently avoiding costly and time-consuming litigation. We also have a strong enforcement and anti-counterfeiting practice. Anti-counterfeiting is a significant problem for the Bolivian market, and we protect our clients’ brands with a personal touch and vested interest that it is not found elsewhere.
